General Terms and Conditions for end customers (out of Germany)

1. Delivery

We usually ship our products  with DHL, DPD or GLS.

2. Payment

Either COD (cash on delivery) or prepayment is accepted for customers in Germany. For customers outside Germany only prepayment is acceptable. Regrettably, we do not accept credit cards or charge cards. Paying with www.paypal.com is possible.

3. Postage and Packing

For postage (including packaging) we charge  5,90 within Germany plus 3,80 for Cash on Delivery. For deliveries to Austria, Switzerland, France, Great Britain, the Netherlands und Luxembourg we charge 34,51 EUR.

4. Right of withdrawal and return

Customers have the right to cancel their order, without stating any reason, within fourteen days after receipt of the goods. The revocation period commences on the day on which you have taken possession of the goods.

To exercise your right of withdrawal, you must contact us straight away via means of a letter, fax or e-mail (see below) or send back the not required goods immediately. Please send back the items in unused condition and in their original packaging. You bear all direct costs of returning the goods.

If you revoke this contract, we will refund all payments that we have received from you, without discounts within 14 days, as long as the product has been proven to be returned to us. Unless otherwise agreed, we use the same method for the refund that was used for the original transaction.

Products not listed in our catalogue, custom made speaker cabinets and other custom made products and services may not returned for credit or refund.

5. Delivery, Acceptance and Default of Acceptance

If the goods ordered are not in stock the customer will be informed within 2 days after receipt of order when delivery will take place. Goods that are in stock will be dispatched within 2 days after receipt of order. 

We are always trying to meet the indicated delivery time. A guarantee, however, cannot be given. Any right of recourse due to delayed delivery is excluded.   

6. Damage in Transit

We carefully check all goods before and during dispatch. Should a customer receive a shipment with goods damaged in transport please consult your postal service; they will assist in completing the necessary claim form.   

7. Validity of our Terms and Conditions

By placing an order with us or by accepting a delivery the customer accepts our Terms and Conditions. Terms and Conditions specified by the purchaser or subsidiary agreements are only valid, once they have been confirmed by us in writing. Severability clause: In the event that any term hereof should be or become invalid, this shall not affect the validity of the remaining terms.

8. Copyright

All documents supplied are for personal use only. No documents may be passed on to third parties without our prior consent in written form.  

9. Retention of Title

All goods supplied remain our property until fully paid. 

10. Warranty and Liabilities

We honor the 2 year warranty applicable in Germany. A  longer and more comprehensive warranty provided by a manufacturer will passed on to our customer. 

Possible defects of parts of the shipment may not result in rejecting the entire shipment. We are allowed to remedy defects. 

Indicated properties and descriptions of products originate from our suppliers and are to the best of our knowledge. All properties and descriptions are subject to change. 

Our customer should check carefully whether a specific product to be ordered is useful in a set-up. We suggest to be contacted before hand to avoid mismatch.    

The warranty expires, if the customer modifies our products without our prior consent in written form.

11. Paying the freight charges for returns

In the case of justified complaints within the warranty period, the freight costs shall be borne by us. Please pay the postage for the present, we will refund the postage fees immediately. Exceptions are traders and OEM customers, who pay the postage charges on their own.

12. Conclusion of Contract

By sending your order, you submit an offer to purchase a product. After placing the order, you receive an automated order confirmation by email. This order confirmation is no acceptance of your offer, it is only to inform you that we have received your order. If you want to know more about the acceptance, please answer to our automated email.

The order is accepted by us when we send an email confirmation to you that we have dispatched the goods.

Lautsprechershop Daniel Gattig GmbH offers his products only to fully contractually capable members or members acting with the consent of their legal representative.

13. Jurisdiction and Place of Performance

The place of performance for delivery and payment as well as the place of jurisdiction is Karlsruhe / Germany. The business relations shall be exclusively subject to the laws of the Federal Republic of Germany. The application of the Vienna Convention on the International Sale of Goods (CISG) is excluded.
